Reasons
Punishment of the crime
[criminal power] On May 2, 2013, the Defendant was sentenced to one year of imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, at the Incheon District Court on July 23, 2015, to one year and two months of imprisonment with prison labor for larceny at the Suwon District Court on May 19, 2017, and one year of imprisonment with prison labor for a habitual larceny at the Suwon District Court on May 12, 2018, and completed the execution of the sentence at the Suwon District Court on May 12, 2019.
【Criminal Facts】
The defendant committed the following crimes in a state that the defendant lacks the ability to discern things or make decisions due to the shock disorder:
1. The crime committed on June 9, 2019;
A. On June 9, 2019, around 16:21, the Defendant: (a) placed in a “D” store managed by the victim C in the second underground department store of Seodaemun-gu Seoul, Seodaemun-gu, Seoul, in a 2nd class; (b) placed in a paper room, the victim’s market price of 49,000 won, which was the victim’s ownership, caused a gap in the management of the victim’s fault; and (c) cut off with one sheet in which the victim’s market price of KRW 49,00,00, which was the victim’s ownership, continued to suffer from the above display room.
B. At around 16:25 on the same day, the Defendant: (a) placed the victim E in a “F store managed by the victim E on the second underground floor of the above B department store; (b) placed the victim’s crehion in a paper room, which prepared one sheet in advance, of the market price equivalent to KRW 58,00,00, which was the victim’s possession, caused a gap in the management of the victim’s fault in a store display room.
C. At around 16:32 of the same day, the Defendant: (a) placed the victim H in “I” store managed by the victim H on the 5th floor of the B department store; (b) placed the victim’s crepit in a paper room, which prepared two parts of the market price of the victim, which was the victim’s possession, in total, 9,800 won.
2. Crimes committed on June 30, 2019;
A. On June 30, 2019, the Defendant is on the first floor of the J department store in Guro-gu Seoul, J department store around 15:36.
