Defendant
A shall be punished by a fine of 300,000 won and by a fine of 700,000 won, respectively.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
D and Defendant B, as well as Defendant B’s husband and wife, suffered damage in the course of purchasing land through the mediation of Victim E’s wife F, but F did not meet the responsibility and did not look at the clothing store operated by the victim and the clothing store operated by the victim.
1. The defendant B and D's obstruction of business
A. Defendant B and D conspired with each other from August 17:00 to 18:30, 2013, and thereby interfere with the victim’s clothes sales business by force for about one hour and thirty minutes by finding the victim from “H” clothing points located in G when the victim was operated from August 9, 2013 to August 18:30 on the ground that the wife does not assume responsibility for causing damage to the victim’s wife, and thereby preventing the victim from entering the customers who were suffering from a disturbance of “spawn, spawn, and spawn,” and by preventing them from entering the said space.
나. 피고인 B와 D는 공모하여 2013. 8. 29. 19:30경부터 20:30경까지 위 1항의 장소에서 위와 같은 이유로 “돈을 갚아주라, 고소를 해라, 고소를 안 하면 니가 병신이다!!”라고 소리를 지르며 소란을 피워 그곳에 들어오려던 손님들을 들어오지 못하게 함으로써 약 1시간 동안 위력으로 피해자의 의류판매 영업업무를 방해하였다.
2. The Defendants and D’ interference with their business
A. From August 26, 2013 to 20:25, the Defendants and D interfere with the victim’s clothes sales business by force for about one hour by: (a) making it impossible for the Defendants and D to enter the customers who were going to enter the said place by making sure that they would have been aware of fraud; (b) having paid the principal for having been punished by fraud; (c) having taken over I real estate; or (d) having not been engaged in business; and (d) having a noise; and (c) having prevented them from entering the said place; and
B. The Defendants and D conspired with each other for the foregoing reasons at the place under the foregoing paragraph (1) from August 28, 2013 to August 20, 2013.
