A defendant shall be punished by imprisonment for not less than three years and six months.

1. The Defendant is the employer who ordinarily worked as the representative director of the N Construction in Bupyeong-gu Incheon Metropolitan City, with 300 full-time workers employed by the Defendant, who performed the construction of a structural frame at the P site located in the P site located in the Yong-gu, Seoul Metropolitan City.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money and valuables within 14 days after the cause for such payment occurred, unless the date is extended by mutual agreement between the parties concerned, in special circumstances.

However, the Defendant is working on the spot from May 1, 2013 to June 17, 2013.

Without agreement on the extension of the due date of Q and the date of payment for retired workers, the amount of wages of 4.8 million won on May 17, 2013 was not paid within 14 days from the date of retirement, and the total amount of wages of 396 won as stated in the attached Table Nos. 1 through 64, 66 through 68, 70 through 124, 126 through 399 was not paid within 1,32,542,695 on June 14, 2013.

2. The Defendant, as the representative director of the NConstruction Co., Ltd., located in the Bupyeong-gu Incheon Bupyeong-gu M building 602, performed a structural construction work at the construction site of Sejong-si R Co., Ltd.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money, valuables, and retirement allowances within 14 days after the cause for such payment occurred, unless there exists an agreement extending the fixed date between the parties concerned.

Nevertheless, the Defendant is working at the construction site from May 10, 2012 to June 18, 2013.

On April 2013, 2013, wages of 2.22 million won, retirement allowance of 2,403,430 won was not paid within 14 days from the date of retirement, as stated in the separate sheet Nos. 1 through 8, 10, 12 through 18, 20, 22 through 24, 26 through 37, and 39 through 105, the total amount of wages of 98 retirement workers is 176.
