Summary of Grounds for Appeal

In full view of the statements of the victims and witnesses and the statements of the injury diagnosis report, the defendants jointly recognize the fact that the defendants inflicted bodily injury on the victims.

Nevertheless, since the court below acquitted the Defendants, it erred by misapprehending the facts and adversely affecting the conclusion of the judgment.

The summary of the facts charged of the instant case is as follows: (a) around 20:00 on October 19, 2013, on the alley side of the “F Kinginginging-up” side of the “Fing-King-si” side of the victim G, and Defendant A went beyond the floor to dump the part of the victim, and (b) ran the victim’s clothes back, and then, Defendant B and C were combined with the fing-up, so that the victim’s face and clothes were dumpeded to require approximately two weeks of treatment.

Judgment

The court below held that the victim's investigation agency and the court below's statement consistent with the facts charged are as follows: ① The CCTV submitted by the defendant A used the victim to assault the defendant A and to speak it only; ② the witness I, the president of the "F KMMY", stated that the defendants did not see the scene of assaulting the victim; ③ the defendants, the victim, and the witness of the court below are not in accord with each other; ④ the defendants' statements concerning the place where the victim was abused; ④ the defendants' leading the victim in the course of assaulting the victim; ⑤ the fact that the victim led the victim to the victim; ⑤ there is a possibility that the witness might mislead the defendants as assaulting the victim; ② the injury of the victim was likely to occur in this process; and ② the victim expressed his intent to pay medical expenses to the defendant immediately after the occurrence of the case.
