피고인은 2020. 3. 2. 23:10경 서귀포시 B아파트 C호에 있는 피고인의 집에서, ‘부서지는 소리, 때리는 소리, 우는 소리, 시끄럽게 들린다. 애기 울고 남성이 소리치고 있고.’라는 가정폭력 의심 112신고를 받고 출동한 제주서귀포경찰서 D지구대 소속 경사 E 등 2명이 현관 출입문을 열고 나온 피고인의 배우자인 F의 머리에 상처가 있는 것을 발견하고 치료를 받도록 권유하던 중 위험한 물건인 라이터 기름을 현관 바닥에 뿌린 후 지포 라이터에 불을 켠 채로 F으로 하여금 집 안으로 들어오게 하고, 경찰관들에게 “문 닫아. 가족 싸움에 누가 신고했어. 이건 가정 싸움이야. 그 정도는 우리 가정에서 해결해. 문 닫고 가요. 진짜. 이게 장난이 아니에요. 25살 연하하고 사니까 나도 힘들어. 그러니까 그만 가요.”라고 하였다.
