1. The Defendant (Counterclaim Plaintiff) paid KRW 1,498,569 to the Plaintiff (Counterclaim Defendant) and its amount from December 18, 2015 to November 3, 2016.

On January 15, 2009, the Plaintiff (Counterclaim Defendant; hereinafter “Plaintiff”) entered into a contract to lease approximately 15 square meters (102 square meters (hereinafter “instant store”) of KRW 300,000,000,000 for deposit money, KRW 300,000 for rent, and the term of lease from February 2, 2009 to February 1, 201 (hereinafter “the first lease contract”) to the Defendant (Counterclaim Plaintiff; hereinafter “Defendant”) among the two buildings located in the lux roof of the light steel-frame slive steel-frame structure, and transferred the said building to the Defendant.

At the time of the above lease agreement, the Plaintiff and the Defendant agreed to increase the monthly rent of KRW 3.50,000 after one year.

On June 15, 2010, the Plaintiff entered into a lease agreement between the Defendant with a deposit amounting to KRW 3 million for the instant store, and the rent amounting to KRW 450,000 per month and the lease period from June 15, 2010 to June 15, 2012 (hereinafter “second lease agreement”).

The lease contract was implicitly renewed on June 15, 2012.

2. Judgment on the plaintiff's assertion

A. The main point of the claim is 50,000 won out of the rental deposit and the remainder of 2.5 million won was unpaid.

The defendant did not pay 2,835,480 won out of monthly rent according to the first lease contract.

The defendant did not pay the rent of KRW 7,381,770 until June 9, 2014 under the second lease contract.

The defendant shall pay to the plaintiff the monthly water use fee of KRW 10,000,000, which shall be paid to the plaintiff. Thus, the defendant shall pay 6,40,000 won to the plaintiff from February 2, 2009 to June 9, 2014.

Therefore, the defendant is liable to pay to the plaintiff 10,350,250 won after deducting 500,000 won from the sum of unpaid rent and water rate of KRW 10,857,250.

B. Determination 1 written evidence No. 5 and No. 1 in the amount of the deposit that the Defendant paid to the Plaintiff, respectively.
