Defendant
A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 1,000,000.
The Defendants respectively.
Reasons
Punishment of the crime
Defendant
A was sentenced to one year of imprisonment for a crime of fraud at the District Court on January 12, 2012, and the judgment becomes final and conclusive on May 18, 2012, and Defendant B was sentenced to two years and six months of imprisonment for a crime of fraud, etc. at the Suwon District Court on January 17, 2013, and the judgment becomes final and conclusive on January 25, 2013.
1. Defendant A
(a) Any person who intends to operate a credit business shall register with the competent administrative agency;
Nevertheless, on September 28, 201, the Defendant, without registering with the competent authority, lent Franchis to E in the wheel chairs plant of the “D” in Gwangju-si, and provided 7.2 million won due date for payment, and lent 7.2 million won to E in November 28, 201, under the condition of 800,000 won per interest, and operated credit business without registering with the competent authority.
B. The Defendant loaned KRW 7.2 million to E at the date, time, and place specified in paragraph 1(a) and received interest of KRW 80,000 per month, and received interest of KRW 133% per annum exceeding that of an unregistered credit service provider (30% per annum).
2. On September 28, 2011, Defendant B: (a) indicated in the column of the certificate of vehicle transfer as “In Incheon Gyeyang-gu H lending 5-401, I, J, and G; (b) stated in the column of the transferor of the certificate of vehicle transfer as “Incheon-gu H lending 5-401, J, and JJ”; (c) stated in the column of the debtor of the standard contract for loan transaction as “TG rental 5-401, and “TG G” in the column of each owner of the certificate of vehicle waiver; (d) stated in the column of each seller and each seller of the letter of consent to the agreement as “YY 5-401 G”; and (e) stated in the column of each seller and each seller of the letter of consent to the agreement as “TG 5-5,401,” making in each column of the letter of vehicle performance, “TG, G, Incheon, Incheon, Gyeyang-gu 501, J-41,” and “N-41, an issuer of the letter of vehicle transfer.
