A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

The defendant is a military clerk of E polling Station established in Seocheon-gu, Seocheon-si D, who has performed voting affairs as a military clerk of E polling Station in June 4, 2014, as a military assistant in the City Planning Department of Socheon-si and C, which was implemented on June 4, 2014.

1. No person shall forge, or have another person increase or decrease the number of votes;

그럼에도 피고인은 2014. 6. 4. 13:30경 위 투표소에서 같은 투표사무업무를 수행하는 F이 2차 투표용지(도의원, 시의원, 비례도의원, 비례시의원)의 일련번호가 서로 일치하지 않는 2차 투표용지 6매를 빼서 책상 한 쪽에 놓아 둔 것을 발견한 후 같은 날 15:30경 다른 사람들이 보지 않는 틈을 타 위 2차 투표용지 6매를 손에 쥔 다음 다른 투표사무원들이 눈치 채지 못하도록 2차 투표함으로 다가가 이를 집어넣었다.

피고인은 10분 후인 15:40경 자신의 책상 위에 놓여있던 일련번호가 일치하지 않은 1차 투표용지(시ㆍ도지사, 시장ㆍ군수ㆍ구청장, 교육감) 3매를 접은 후 그 위에 자신의 핸드폰을 덮어 놓았다가 자신의 핸드폰과 같이 밑에 있던 1차 투표용지 3장을 손에 쥔 다음 1차 투표함에 다가가 다른 투표사무원들 몰래 이를 집어넣었다.

2.
