1. The Defendant shall pay to the Plaintiff KRW 41,639,610 as well as 20% per annum from December 18, 2014 to the date of full payment.

1. Facts of recognition;

A. On June 20, 2013, the Plaintiff entered into a contract with Dal Integrated Construction Co., Ltd. and the Plaintiff to be paid the price for supplying ready-mixed at the site of the construction of the Eastan Industrial Complex (hereinafter “supply contract”). The Defendant jointly and severally guaranteed the Plaintiff’s debt against Dal Integrated Construction Co., Ltd.

B. The Plaintiff supplied ready-mixed at the aforementioned construction site from June 20, 2013 to August 14, 2013, and was not paid KRW 41,639,610 out of the price of ready-mixed.

According to the above facts of recognition, the defendant, a joint guarantor, is obligated to pay to the plaintiff 41,639,610 won unpaid and delay damages at the rate of 20% per annum under the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings from December 18, 2014 to the day of full payment, as requested by the plaintiff.
