A defendant shall be punished by imprisonment with prison labor for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On January 28, 2020, at around 00:30, the Defendant spited the cab on the backwards of Jinju-si, which was driven by B on the same-dong (hereinafter referred to as the same-dong). Around 00:30 on January 28, 2020, the Defendant spited into the backwards of Jinju-si.

Then, B did the defendant go to the police station, and the defendant was aboard the above taxi and went to the police station D area in the Jinnam-si Police station in the Jinju-si.

피고인은 같은 날 00:32경 위 지구대에서 당시 근무 중이던 경찰관 순경 E으로부터 택시 안에서 구토를 한 사실이 있느냐고 질문을 받자, 갑자기 E에게 “아니, 지금 야가 무슨 소리하노. 에라이 새끼야. 내가 침 뱉었나. 내가 뭐 잘못했는데. 내가 뭐 손댔는데, 야.”라고 말하면서 손으로 E의 몸을 1회 밀치고, 이어 E에게 “놔 임마.”라고 말하며 손으로 E의 몸을 1회 밀치고, 계속하여 손으로 E의 뺨을 1회 때리고, 몸을 1회 밀친 다음, E에게 “내가 이야기하잖아. 자식뻘도 안 되는 사람이, 너는 안 되겠다.”라고 말하면서 손으로 E의 몸을 1회 밀치고, E에게 “짭새, 마 임마.”, “임마 이거는 안 되겠다. 니는 사람 새끼 안 돼, 새끼야.”라고 말하면서 손으로 E의 몸을 2회 밀치는 등 E을 폭행하였다.

Accordingly, the defendant interfered with the legitimate execution of duties of police officers on the maintenance of public peace and order.
