1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit shall be borne by each person;
Reasons
1. Determination as to the cause of claim
A. The plaintiffs' assertion that the defendant is a corporation entrusted by the Korea Electric Power Corporation with the affairs such as inspection of electric measuring instruments, the delivery of bills related to charges, the termination, construction, and re-supply (transmission), etc. to customers in default of charges. The plaintiffs are employees who retired from office on each date stated in the "retirement Date" column of the attached retirement allowance calculation table with the defendant after entering into an employment contract with the defendant on each date. The defendant is obligated to pay each amount stated in the "Retirement Allowance (20%) of the unpaid retirement allowance table.
B. The reasoning of the judgment is insufficient to acknowledge the fact that the plaintiffs are the defendant's workers, and there is no other evidence to acknowledge it. Thus, the plaintiffs' claims are without merit.
2. Determination on the Defendant’s defense of extinctive prescription (family determination) can be seen as the Defendant’s defense that, even if the Plaintiffs are the Defendant’s employees, the Defendant extinguished the extinctive prescription period, and thus, the Plaintiffs’ right to claim retirement allowances has run for three years from July 31, 201 or from December 31, 201, which the Plaintiffs asserted that they retired, and it is apparent in the record that the Plaintiffs received the instant application for conciliation on May 5, 2017 when three years have passed since the Plaintiffs retired. As such, the Plaintiffs’ right to claim retirement allowances has expired after three years have elapsed from the date of retirement. The Defendant’s defense of extinctive prescription is well-grounded, and the Plaintiffs’ claim is without merit.
3. In conclusion, the plaintiffs' claims are dismissed in entirety as it is without merit. It is so decided as per Disposition.
