2. On September 25, 2014, the Defendant posted a notice stating “sale of opphone 5” on the Internet net “Nphone ” website, and sent the same attitude to deliver goods normally when depositing the sales proceeds to the victim G who contacted with the Defendant.

However, even if the defendant did not have any goods to be sold and received the payment of goods from the victim, he did not have an intention or ability to deliver the goods that he promised to consume due to living expenses, etc.
