[Defendant A] Defendant A shall be punished by imprisonment with prison labor for ten months.
However, the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Defendant A
(a) Any person who intends to engage in a loan business without registration shall register his/her business with a Special Metropolitan City Mayor, Metropolitan City Mayor, Metropolitan Autonomous City Mayor, Do Governor, or Special Self-Governing Province branch office (hereinafter referred to as "Mayor/Do Governor") having jurisdiction over the relevant place of business;
Nevertheless, the Defendant, without being registered with the Mayor/Do Governor on March 4, 2017, lent KRW 480,000 to D from the branch of the branch of the Marina Association of Korea located in 31-gil-ro 31, Sungnam-si, Sungnam-si, Sungnam-do, to around November 3, 2017, from that time, up to November 3, 2017, run a loan business without registration, directly or through B, which directly or in fact employs KRW 219,621,00 in total for 706 times against the horse users, such as the daily list of crimes (1).
(b) Where a credit service provider without registration in violation of the limited interest rate lends a loan to an individual, it shall not receive interest exceeding 25% per annum from July 15, 2014 to February 7, 2018.
Nevertheless, around March 19, 2017, the Defendant loaned 240,000 won, deducting 60,000 won from 30,000 won from 30,000 won at the branch of the above Korea Mar. 19, 2017, and received 300,000 won as principal and interest, and received annual interest at 1,303% from 30,000 won as principal and interest, and received interest from 1,303% from 27, 2017 to 114 times as shown in Table of Crimes List (2).
2. Defendant B, despite being aware of the fact that the above Defendant B engaged in a loan business without registration and received interest exceeding the limited interest rate, he/she was employed on the condition that he/she would receive KRW 1,800,000 per month from a policeman during August 2017, and from that time, he/she waits at the underground parking lot of the branch office in the Marin society of Korea until November 3, 2017.
