1. The Defendant occupational embezzlement is an employee employed by the victim C, who is engaged in the clothing brokerage from January 2015 to May 2015, who received the purchase price for the clothes from the injured party, and was engaged in the business of purchasing clothes from each prize in Jung-gu Seoul Metropolitan Government.

On February 6, 2015, the Defendant received KRW 1,00,000 from the injured party in the vicinity of the Seoul Jung-gu D shop as the purchase price for clothes from the Defendant to the national bank account (E) in the name of the Defendant and used KRW 537,00 among them for personal purposes, such around that time, the Defendant used KRW 537,00 for the money in the vicinity of the D shop.

In addition, from February 6, 2015 to May 2, 2015, the Defendant consumed a total of 63,953,000 won by the same method over 30 occasions as shown in Appendix I, as shown in Appendix I.

Accordingly, the defendant embezzled the victim's property.

2. No person who violates the Promotion of National Sports Act shall gambling by using an act of offering property or property benefits to a person who has issued (including the issuance through an information and communications network) sports promotion voting rights or things similar thereto to the Korea Sports Promotion Foundation or a person who is not an entrusted business entity and issued (including the issuance through an information and communications network).

From February 1, 2015 to June 18, 2015, the Defendant subscribed as a member of “F”, a private sports soil entertainment site, from the Defendant’s mobile phone near the Seoul Jung-gu Seoul Metropolitan Government, to the Defendant’s mobile phone, and deposited KRW 126,583,500 in total over 424 times from the national bank account used by the Defendant to the account designated by the said website operator, as shown in Appendix II, as shown in Appendix II, and deposited KRW 126,583,50 in all the corresponding game money and predicted the result of the sports games in Korea and abroad, such as a axis, for filling the corresponding game money, and for paying a certain percentage of dividend depending on whether or not the money is valuable.
