Defendant B, a corporation, within seven days from the date this judgment became final and conclusive, shall be as shown in attached Form 1-1 and 1-1 on the initial screen of G website (H).
Reasons
1. Basic facts
A. The Plaintiff is a person who held office as the president of Yangcheon-gu Seoul Metropolitan Government Mice Ma-listed (hereinafter “Mice-listed”) and Defendant B (hereinafter “Defendant Company”) is a company operating broadcasting business and Internet broadcasting-related business under the Broadcasting Act, and operates and manages the website of “G” as an Internet newspaper, and Defendant C, D, E, and F was a reporter belonging to the Defendant Company.
B. Each of the instant reports 1) Defendant Company: (a) on the G website (H) around 11:02 on July 24, 2018, an article of the title K of K Act (hereinafter “instant article 1”).
A) Around 9:55 on August 10, 2018 (hereinafter “the instant Second engineer”) an article called “L” (hereinafter referred to as “instant engineer”).
A) Around 11:05 on August 13, 2018 (hereinafter “instant third engineer”) a title “I” (hereinafter “instant third engineer”).
A) Around 10:05 on August 16, 2018, an engineer of J Act (hereinafter referred to as “instant fourth engineer”)
Each of the instant reports (hereinafter referred to as “each of the instant reports”) posted each of the instant articles (hereinafter referred to as “each of the instant articles”).
(1) Articles 1 and 1 (No. 24, 2018) reporting No. 1 of the instant article (No. 2018) reporting (No. 1) were entrusted with the management of Mice listing from January 1, 2017 to December 31, 2019 following the public invitation process by Seoul Special Metropolitan City. ② N is a public announcement of appointment of a director of Mice listing on March 2017 (hereinafter “instant employment announcement”).
According to the employment announcement of this case, the recruitment period is more than seven days even though the maximum amount of the annual salary is 100 million won, and the qualification for application is limited to "persons with career experience of not less than three years as a manager of public sports facilities", "public facilities, organizations, and business management manager for not less than five years", and in particular, the applicants were restricted by taking the condition of "special treatment for those with career in the operation of the same sports facilities, such as ice listing".
③ A person who applied for the employment procedure of Mice-listed director was only two persons including the Plaintiff, and the Plaintiff finally participated in an interview by other persons.
