The defendant's appeal is dismissed.

1. The summary of the grounds for appeal is that the defendant was unaware of money for investment purpose by deceiving B, and that the defendant made a false accusation against B and testified in the court, and that the defendant made a false accusation against B and perjury does not constitute a false accusation.

In addition, the Defendant completed the execution of punishment on May 29, 2016, and the instant crime was committed before, and thus, the Defendant is not a repeated offender.

2. Determination

A. Inasmuch as the fact that a criminal judgment already became final and conclusive on the same factual basis is material that is sufficiently evidence, it cannot be recognized that the fact is contrary to the fact that it is difficult to adopt a factual judgment in the relevant criminal trial, barring any special circumstance.
