Reasons
Punishment of the crime
On March 22, 2009, the Defendant was sentenced to a fine of two million won at the Daejeon District Court on September 22, 201, on the following grounds: (a) although the Defendant did not have been elected as the representative of the C Branch, the Defendant was elected as the representative of C Branch through a lawful clan meeting; and (b) as if the Defendant decided to change the name of the said clan into D Branch, the name of the said clan was decided to be changed to D Branch, the name of the said clan was forged.
1. Unwritten statements in the original notarial deed and uttering of the original notarial deed;
A. On April 7, 2009, the Defendant filed an application for registration of the change of the name of the clan 5,372m2 with the registration official who is not aware of the fact that the Defendant had been elected as the representative of the clan C or decided to change the name of the said clan into D'D', the Defendant added "A" to the name of the representative of the said clan in the land register of the said clan on April 7, 2009. The name of the said clan was "D, the principal office of the said clan," "Seoul-do, the head office of the said clan," "Seoul-do, the head office of each of the said clan," had the registration official enter the registration of change into the original family register by means of a total of 13 times as shown in the attached list of crimes (1) so that the above registration official falsely recorded the registration of change into the original family register and made the public official enter the same fact in the electronic record register of the said clan so that the registration official can exercise the registration of change into the original land.
B. On April 9, 2009, the Defendant committed the crime on April 9, 2009, in the Seosan District Court’s Seosan Branch of the Daejeon District Court, located in 24-ro 4, Seosan-si, Seosan Branch of the District Court on April 9, 2009, in Seosan-si H 1.
