Reasons
1. Basic facts
A. The Korea National Housing Corporation (the Korea National Housing Corporation and the Korea Land Corporation were merged with the defendant on October 1, 2009; hereinafter the same shall apply) obtained approval for a housing construction project plan from the Governor of Gangwon-do in accordance with Article 33 of the former Housing Construction Promotion Act (Act No. 6250, Jan. 28, 2000; hereinafter the “Gu Housing Construction Promotion Act”) with respect to the construction of public rental housing at the Hancheon-gun A, Gangwon-do, Gangwon-do.
B. On the above ground, the Defendant decided to construct and lease six publicly constructed apartment units, 464, Dong-dong, 464 (hereinafter “instant apartment units”), and publicly announced the invitation of occupants on April 2003. Around that time, the Defendant agreed to lease the above apartment units to the Plaintiffs for five years.
C. In around 2009, the Defendant issued a notice to the occupant of the instant apartment, including the Plaintiffs, on July 2009, that the mandatory rental period of the instant apartment was Do and the conversion period for sale was 52,014,00 won of the construction cost of the household corresponding to 66m2 of the instant apartment, and that the construction cost of the household corresponding to 77m2 square meters of the instant apartment shall be 60,760,000 won, respectively, and that the Plaintiff and the remaining designated parties shall enter into a sales contract with the occupant of the instant apartment. Accordingly, on July 2009, the Plaintiff and the instant designated parties shall be subject to the attached Form
2. The term “Dong and lake” in the calculation table concluded a contract with the content that each apartment unit is sold in the same way as the sale price indicated in the same calculation table (hereinafter “each sale contract of this case”). D.
The Plaintiffs paid all the above sales price to the Defendant according to each sales contract of this case.
