Criminal facts

However, the defendant thought that he will use the borrowed money for the repayment of personal debt, living expenses, etc., and even if he/she borrowed money from the victim due to no particular property or income, he/she did not have any intent or ability to pay the borrowed money in return for it.

Nevertheless, the defendant, by deceiving the victim as above, acquired 5 million won from the defendant's account to the defendant's account.

2. On June 12, 2012, the Defendant who committed the crime against the victim E concluded that “The Defendant would pay the victim advance payment while doing work at the “H” entertainment business operated by the victim in the future,” at the office of the “G Law Firm” located in Pyeongtaek-siF.

However, the defendant thought that he will use the prepaid money for the repayment of personal debt, living expenses, etc., and even if he did not borrow money from the victim due to no particular property or income, he did not have any intent or ability to pay the money in full.

Nevertheless, the Defendant, by deceiving the victim as above, received the remittance of KRW 10 million to the Defendant’s account.

3. Around October 8, 2015, the Defendant who committed the crime against the victim I false statement to the victim “I will pay the amount of advance payment to the victim at the main place of the payment of advance payment at Gangseo-gu, Busan.”

However, the defendant thought that he will use the prepaid money for the repayment of personal debt, living expenses, etc., and even if he did not borrow money from the victim due to no particular property or income, he did not have any intent or ability to pay the money.
