A defendant shall be punished by imprisonment for six months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On May 13, 2008, the Defendant issued a summary order of KRW 1 million as a crime of violating the Road Traffic Act at the Seoul Central District Court on May 13, 2008, and KRW 1 million as a fine at the Seoul Eastern District Court on October 24, 2008.

The Defendant is a person engaging in driving a benz vehicle B.

On October 31, 2016, the Defendant driving the said vehicle under the influence of alcohol content of 0.115% during blood transfusion on October 31, 2016, and driving the said vehicle along four-lanes in the direction of diving in the direction of locking in the direction of the intersection, as Seoul Songpa-gu Seoul Olympic Games.

At that time, the Defendant tried to change the lanes to three lanes, so in such a case, the Defendant had a duty of care to thoroughly operate the vehicle in the next direction, and to safely drive the vehicle and prevent the accident in advance by operating the vehicle in the third lane.

Nevertheless, under the influence of alcohol, the Defendant neglected to do so and did not properly operate the steering and steering devices, and was driven by the victim D(55) who was in progress on the three-lanes of the same direction, and received the front right side part of the Ekiex vehicle as the front left side part of the instant benz vehicle.

Ultimately, the Defendant suffered injury to the victim D, such as salt, tension, etc., of the species that require approximately two weeks of treatment from the victim D due to such occupational negligence, and driven under the influence of alcohol.
