Defendant

A Imprisonment with prison labor of one year and six months, and Defendant B shall be punished by imprisonment with prison labor of ten months.

However, as to Defendant B, the same shall apply.

Punishment of the crime

[criminal records] Defendant A was sentenced to eight months of imprisonment for fraud at the Busan District Court on December 5, 2012 and completed the execution of the sentence on August 3, 2013.

[Criminal facts] Defendant A is the actual owner of the 17-year household in Busan Dong-gu and the 16-year household in Northbuk-gu in Busan, and Defendant B is the real estate broker.

Although Defendants intended to borrow the above two buildings as collateral, they offered to obtain a forged lease contract by submitting a forged lease contract by stating the lower lease deposit in the way that it is difficult to borrow the leased deposit and the existing loan due to the excessive amount of lease deposit.

1. Defendant A

A. On June 2015, the Defendant: (a) in collusion with B, entered the form of a real estate lease agreement using a computer in G real estate located in F, located in Busan-gu, Busan-gu, with a view to lowering the amount of “3 million won guaranteed”; (b) entered the original text of the lease agreement No. 101 as “3 million won guaranteed”; and (c) entered the lessee’s name in advance, affixed the lessee’s seal; and (d) entered the lessee’s seal in the name; and (e) entered the lease agreement No. 13 as indicated in the list of crimes in the attached Table.

Accordingly, the Defendant, in collusion with B, forged the 13th chapter of the lease contract under the name of each lessee, which is a private document on rights and obligations without authority.

B. On June 23, 2015, the foregoing investigation document B sent 10 pages of the above G real estate to the staff of the hot spring resort credit cooperative as if the 10th head of the forged D studio lease contract was actually prepared by facsimile, and on the same day, at the same place on the 25th day of the same month, sent 3 copies of the forged E Do lease contract to the staff of the hot spring resort credit cooperative as if it was actually prepared in a genuine manner.

Accordingly, the defendant committed each of the forged private documents in collusion with B.
