Reasons
1. Basic facts
A. The defendant is a company that carries out business activities such as support for lifelong learning of workers, provision of workplace skill development training, qualification examination, technical encouragement, and promotion of employment based on the Korea Manpower Agency, and the plaintiffs are employees who have entered into an employment contract with the defendant.
B. Among the plaintiffs' employment transfer experience and employment process, majority of the plaintiffs worked in public agencies such as Korea Exchange Bank and other private enterprises or employment security centers, etc. prior to their employment. In particular, males have experience in most of their military service.
Since around 199, the Plaintiffs were employed as the Defendant’s professional or commercial employee, and performed duties such as employment promotion, foreign employment support projects, lifelong learning projects, and overseas employment projects. At the time, the Plaintiffs were employed through document screening and interview, and some of them were subject to a separate written examination to measure foreign language proficiency, etc.
The Plaintiffs, as fixed-term workers, have entered into a one-year employment contract with the Defendant, and have been engaged in their duties by renewal each year.
C. The Defendant of working conditions regulates all kinds of working conditions, such as personnel management and remuneration, through the personnel management and remuneration regulations (hereinafter “the instant remuneration regulations”) for regular workers including class 6 workers in general service belonging to the Defendant, and separately stipulates matters necessary for personnel remuneration, etc. for non-regular workers including the Plaintiffs.
