Reasons
Punishment of the crime
1. The Defendant of the crime of the conspiracyd Telecommunications Financial Fraud, posted on the Internet, received a proposal from the Defendant that “The Defendant, by misrepresenting the staff of the Financial Services Commission, sent money in return for the job seeking “from KRW 500,000 to KRW 1 million,” and that “The Defendant would receive cash from the victims of Bophishing who misrepresented the staff of the Financial Services Commission, and transfer money to the designated account through a designated account without passbook remittance method.” The Defendant accepted the proposal that “The Defendant shall carry out the receipt of an official letter from the Financial Services Commission sent out by e-mail to the victims so as not to doubt the victims, and shall deliver money to the victims when receiving money from the victims.”
2. Criminal facts;
A. On January 20, 2020, the Defendant conspiredd as above with the above person with the above name omitted, and on January 20, 2020, the Defendant printed five copies of the documents in the name of the Chairman of the Seoul Central District Public Prosecutor's Office and the Financial Services Commission, including the Seoul Central Public Prosecutor's Office and the Financial Services Commission, stating the content of the investigation under the name of the Chairman of the Financial Services Commission, for the purpose of exercising the victims of Bophishing in the PC room near Songpa-gu Seoul Songpa-gu Seoul District Public Prosecutor's Office to the victims of Bophishing.
Accordingly, for the purpose of exercising, the Defendant forged five copies of official documents in the name of the Chairman of the Financial Services Commission.
B. The Defendant, who attempted to commit fraud, is recruited as above with the above person who was not aware of his name. On January 20, 2020, at around 10:00, the person who was not aware of his name, misrepresented the victim B with the Seoul Central District Inspection C, the Guro Police Station D, and used the party account for the crime.
