1. Defendant A shall be punished by imprisonment with prison labor for a period of ten months.
However, the above sentence shall be executed for a period of two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
[criminal record] On September 23, 2016, Defendant B was sentenced to imprisonment with prison labor for a crime of fraud at the Seoul Central District Court on September 23, 2016 and completed the execution of the above punishment on September 20, 2017.

1. On September 22, 2017, Defendant A expressed a letter of the victim E’s purchase of the spackers posted by the Internet Internet NAVER Kafa in the middle country.
When the defendant remitted money to the victim with contact, the defendant will deliver the above goods.
A false statement was made.
However, the defendant did not have the intention or ability to sell the above goods.
Defendant deceiving the victim as above and transferred KRW 12:41 450,000 on the same day to the deposit account (F) in the name of the Defendant’s bank from the victim.
In addition, the Defendant, as described in the attached Table 1 to 4, received a total of KRW 3,020,000 from four victims, as shown in the attached Table 1 to 4.
2. On September 26, 2017, the Defendants gathered that they would acquire money and use money together by posting false comments on the Internet.
On September 26, 2017, Defendant A, at around September 26, 2017, sent money by reporting the purchase of a mobile phone posted by the victim G to the Internet NAV car page “China” and communicating the money to the victim.
Defendant B received 20,000 won from the victim’s account by providing his bank account (H) with his money remittance account.
In collusion, the Defendants received 17,580,000 won in total from 34 victims, from time to November 6, 2017, from time by the same method, including by deceiving the victim as above and receiving 200,000 won from the damaged person as the price for goods.
