Punishment of the crime

1. Defendant A is a person who engages in trade business with the trade name “E” in Gangseo-gu Seoul Metropolitan Government C and D.

No one shall invite a foreigner by improper means, such as a false statement of fact or a false fidelity guarantee, to allow the foreigner to enter the Republic of Korea, or arrange such invitation.

On September 2018, the Defendant received a proposal from the Defendant that “I will give 1.50,000 won per person upon receipt of the invitation letter to enable persons in Uzbekistan to enter Korea,” which read, “I will give 1,50,000 won per person upon receipt of the invitation letter to enable persons in Uzbekistan to enter Korea.”

On September 20, 2018, the Defendant: (a) around September 20, the Jongno-gu Seoul Metropolitan Government Hho Law Firm, without the intent or ability to trade the clothing products with E operated by the Defendant; (b) prepared and delivered the false invitation letter, return guarantee note, etc., as if the Defendant invited to trade the clothing products in E operated by the Defendant; and (c) B submitted the said documents to the Embassy of the Republic of Korea in Turkey, and entered the Republic of Korea on November 2, 2018 upon receipt of a short-term visit visa (C-3) visa.

Accordingly, the defendant invited B by illegal means to allow foreign entry into B.

2. No defendant B shall apply for a visa or a visa issuance certificate to enter the Republic of Korea, or arrange such application;

Nevertheless, the Defendant, rather than purchasing clothes from E, enters the Republic of Korea with money earned by entering the Republic of Korea as a result of employment. However, around October 5, 2018, the Defendant applied for a visa to enter the Republic of Korea at the Embassy of the Republic of Turkey, and submitted a visa to obtain a short-term visit (C-3) visa by submitting a letter of invitation for the Representative A of E, as if he/she entered the Republic of Korea as a clothes purchase.
