1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. D, the Plaintiff and the Plaintiff’s spouse, newly constructed reinforced concrete in Busan Southern-gu and cement brick slive slive roof (hereinafter “instant house”), and completed registration of initial ownership on October 14, 1992, respectively.

B. Around April 1, 2012, the Plaintiff and D entered into a lease agreement with F (G’s spouse) on the condition that F will lease the third floor H of the instant housing by setting the lease deposit of KRW 30,000,000, monthly rent of KRW 100,000, and the term of the lease from April 1, 2012 to March 31, 2014.

C. From June 2013, the Plaintiff and D entered into a lease agreement with I on the condition that I will lease the second floor J of the instant housing with regard to KRW 10,00,000, monthly rent of KRW 150,000, and the term of lease from June 25, 2013 to June 24, 2015.

On August 22, 2013, the Plaintiff and D entered into a lease agreement with K to lease the entire first floor of the instant housing with the term of KRW 20,000,000, monthly rent of KRW 900,000, and the term of lease from September 14, 2013 to September 13, 2015.

E. On January 22, 2014, the Plaintiff and D entered into a lease agreement with L with respect to the second floor M of the instant housing, setting the lease deposit amount of KRW 20,000,000, monthly rent of KRW 100,000, and the term of lease from January 23, 2014 to January 22, 2016.

F. On March 18, 2014, the Plaintiff and D entered into a lease agreement with N to grant a lease to N during the term of KRW 10,000,00 for the three-story housing of this case, monthly rent of KRW 150,000, and the term of lease from June 25, 2013 to June 24, 2015.

G. After that, among the instant housing, D’s share was registered on the ground of “sale reservation on September 15, 2015,” and on October 31, 2016, “trade on March 8, 2016.”
