1. The defendant shall be the plaintiff.

1. Basic facts

A. On March 12, 2008, the Plaintiff entered into an insurance contract with the Defendant listed in the separate sheet (hereinafter “instant insurance contract”). Of the insurance terms and conditions contained in the said contract, the part related to the instant case is as follows.

(1) “Cram” means a disease that is classified as malicious life in the Fourth Korean Standard Disease Classification, and the malicious life classification number of a fire extinguishing agency under the said classification is C15 to C26.

The term "salary species" means the disease that is classified as an unidentified or aestheticly new life in the fourth Korean Standard Disease Disease Classification, and the behavior patterns of the fire extinguishing agency according to the above classification is unclear or the aesthetic life is D37.

The diagnosis and confirmation of Sheshedry or the dicopical pattern shall be made by a person who holds a professional doctor's license of the autopsy pathology or clinical pathology, and this diagnosis shall be based on the present opinion about the organization's (fixed stimule), the aesthetic diagnosis of the cancer, or the blood examination, but if it is not possible to conduct a pathological diagnosis, the clinical diagnosis of the cancer is recognized as evidence of cancer, and in this case, there shall be documents or evidence evidencing that the insured is being diagnosed or treated as cancer.

Then, the defendant pays 30,000,000 won when the insured is diagnosed and confirmed as cancer other than high-amount cancer, and 6,000,000 won when the diagnosis and confirmation is made in the form of boundary, and is exempt from the payment of the premium after the next time when the diagnosis and confirmation is made as cancer.

B. The Korean Standard Disease Classification is governed by the International Disease Classification System of the World Health Organization (WHO) under the United Nations. In Chapter 2 of Part 3 (Contents e-mail and Category 4 (Noplas Classification), Noplas (Noplas) are classified according to physical parts, and in case of malicious organisms, the disease classification number of 300-97, behavioral form is unclear or US.
