Reasons
Punishment of the crime
On March 11, 2012, the Defendant borrowed KRW 50,000,00 from the land as collateral because deposit is necessary to obtain a loan to a third-class disability of a mental retardation in order to live together. On March 11, 2012, C confirmed whether the loan was executed by a lender in the Nong Bank, C used a copy of the Agricultural Cash Card of KRW 50,000,000 to collect the above loan by advertising it.
1. Computer, etc. fraud;
A. A. On March 13, 2012, the Defendant, at the cash withdrawal machine at the victim’s Cheongju Agricultural Cooperative Branch of the Seoul Agricultural Cooperative Branch of the Cheongju-si, 291-2, issued the said 30,000,000 won in total, by the same method five times in total, by inserting the NA’s cash card held as above and taking a password, and transferring KRW 6,00,000 from the NA’s agricultural bank account to the NA’s agricultural bank account managed by the Defendant.
Accordingly, the defendant acquired financial benefits of 30,000,000 won by inputting information into a computer or any other information processing device without authority.
B. Around March 14, 2012, the Defendant transferred KRW 15,935,449, total sum of KRW 15,935,449 from the Defendant’s agricultural bank account to D’s agricultural bank account managed by the Defendant, in total, at a cash withdrawal period for a 138-affiliated branch, the Victim Nonghyup Bank Co., Ltd., Ltd., Inc., Ltd., in accordance with the Defendant’s resignation.
In this respect, the defendant acquired financial benefits equivalent to 15,935,449 won by inputting information into a computer or any other information processing device without authority.
2. A thief: (a) around March 14, 2012, the Defendant withdraws KRW 4,00,000,000, in total, four times, including inserting the NAC’s cash card possessed as above and taking a password from the NAC’s NAC’s 1,000,000, at the victim Nonghyup Bank, Inc., Ltd., a New-dong branch cash withdrawal machine located in 502, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, Seoul.
