1. The Defendant’s KRW 36,00,000 and its amount shall be 20% per annum from November 11, 2008 to September 30, 2015 to the Plaintiff.

2. Judgment by public notice (Article 208 (3) 3 of the Civil Procedure Act).

The provision on statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings for Partial Dismissal was wholly amended by Presidential Decree No. 26553 on September 25, 2015 and enforced from October 1, 2015, and thus, the Plaintiff’s claim for damages for delay exceeding 15% per annum from October 1, 2015 among the Plaintiff’s claims for damages for delay is without merit, and thus, is dismissed.
