A defendant shall be punished by imprisonment with prison labor for not more than ten months.
Reasons
Punishment of the crime
On May 11, 2012, the Defendant was sentenced to 8 months of imprisonment for fraud at the Incheon District Court on May 14, 2012, and on May 14, 2012, the Defendant did not have any money or there is no intent or ability to pay the amount to the Defendant for the use to the victim because there is no money in water
1. On October 25, 2012, around 08:05, while working as if the victims D were to pay normally the amount of using the Internet and selling food at the Escam room managed by the victims D of the three floors of the building of the Gu C, while taking advantage of the Internet as if they would normally pay the amount of using the Internet, thereby obtaining pecuniary benefits equivalent to the amount of 49,400 won provided by the victims;
2. On October 28, 2012: (a) around 23:16, the Plaintiff was provided with computer services of an amount equivalent to KRW 25,800 from the victim to October 15:40, 2012; and (b) was engaged in games as if the Defendant would normally pay the cost of use in HPC operated by the Victim G G located in Ansan-gu, Ansan-si, Gyeonggi-do; and (c) was provided with the said amount of financial benefits; and (d) acquired the pecuniary benefits equivalent to the said amount;
3. On October 30, 2012, around 22:00, the Plaintiff was provided with computer-using services and food equivalent to 36,500 won in total from the victim, while driving as if the Plaintiff would normally pay the cost of use at Kpck-si operated by the JJ of the victim I, Seocheon-gu, Seocheon-si and ordering the use of the Internet computer and food, thereby acquiring property benefits equivalent to the same amount;
4. On November 13, 2012, around 19:30 on November 13, 2012, at the “NPC” managed by the victim M of the second floor of Geumcheon-gu Seoul, Geumcheon-gu, as if they would normally pay the cost of use, using an Internet computer and ordering food to use it, thereby obtaining financial benefits equivalent to the same amount after being provided by the victim with the aforementioned services and food equivalent to 23,200 won in total from the victim;
5. On November 16, 2012, around 05:10, the cost of use is normally paid in QP operated by the victim P on the second floor in Gwanak-gu, Seoul Special Metropolitan City.
