1. The Defendant: (a) KRW 279,622,069 to Plaintiff Sungsung Construction Co., Ltd.; and (b) KRW 278,505,813 to Plaintiff Red Construction Co., Ltd.

Facts of recognition

The Plaintiffs, such as the conclusion of the instant construction contract, constituted a joint supply and demand organization with the representative of the Plaintiff Ssung Construction Co., Ltd., with the investment ratio of 50.1% and 49.9% and the representative of the Plaintiff Co., Ltd.

On May 30, 2012, the Plaintiffs concluded a contract for construction work in the form of a long-term continuing construction contract (hereinafter “instant construction contract”) with the Defendant for the primary contract amount of 7,043,392,00 won, total additional construction period of 10,476,464,000 won, the primary and several construction period of 275 days from May 30, 2012 to February 28, 2013, the total construction period of 510 days from May 30, 2012 to October 21, 2013.

Of the general conditions of the construction contract applicable to the instant construction contract (hereinafter “general conditions”), the parts related to the instant case are as shown in attached Table 1.

The Plaintiffs and the Defendant modified the instant construction contract with respect to the instant construction project several times as indicated below. The instant construction project was finally modified to the contract amount of KRW 7,583,97,00, and the deadline for completion of the instant construction project was extended on August 31, 2014. The grounds for extension of the deadline for completion of the instant construction project and the extension period are as follows (2) through (7).
