가. 피고인 A은 2018. 7. 27. 17:50 경 강릉시 율 곡로 2787( 성남동 )에 있는 버드나무공원에서 강아지를 데리고 와 물로 씻기고 있던 중, 강아지가 울부짖는 소리를 들은 피해자 F( 여, 60세) 이 동물을 학대하지 말라며 피고인의 머리를 2회 손으로 밀치자 화가 나, 손에 들고 있던 수건으로 피해자의 얼굴을 5회 때리고, 피해자가 112 신고를 하려고 하자 피해자의 팔을 잡아 뒤로 꺽은 후 주먹으로 피해자의 얼굴을 때려 넘어뜨렸으며, 피해자가 일어나 다시 112 신고를 하려고 하자 주먹으로 피해자의 얼굴 부위를 2회 때려 피해자에게 치료 일수 미상의 뇌진탕 증후군, 볼의 표재성 손상 등의 상해를 가하였다.
