A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

피고인은 2019. 1. 8. 22:32경 인천 연수구 B에 있는, C역 매표소 입구에서 피해자 D(여, 가명, 17세)에게 다가가 “직업이 뭐냐, 술 한 잔 하자, 시간이 되면 모텔에 같이 가자“라고 하며 갑자기 왼손으로 피해자의 어깨를 감싼 후 팔짱을 끼고, 이에 피해자가 피고인의 손을 쳐냈음에도 피해자를 따라 이동하며 같은 날 22:40경 지하철 승강장에서 ”자취하냐, 자취하는 곳에 사람 있냐“라고 말하며 오른 손으로 피해자의 등을 만지고, 계속하여 피해자를 따라 지하철에 탑승한 후 피해자의 오른쪽 옆에 앉아 왼팔로 피해자의 허리를 감싸고, 피해자가 피고인을 피해 인천 연수구 E에 있는 F역에서 하차 후 반대편 승강장으로 도망가자 피해자를 뒤따라가며 손으로 피해자의 어깨를 감싸 안고, 같은 날 23:17경 피해자가 C역에 내려 에스컬레이터를 타자 피해자의 뒤에 서서 오른 손으로 피해자의 허리를 감싸고, 오른 손으로 가슴을 만져 피해자의 어깨를 감싸 안아 피해자를 강제로 추행하였다.
