Punishment of the crime

The Defendant was an election campaign worker in an election campaign office of a candidate G who was sent to the CDE constituency in the 20th election of a National Assembly member on April 13, 2016.

No one shall transmit election campaign information using text messages during the election period by means of automatic broadcast communication utilizing computers and computers, excluding candidates, during the election period.

그럼에도 불구하고 피고인은 위 선거사무소의 선거대책위원장인 H으로부터 인사문자를 보내달라는 부탁을 받고, 2016. 4. 12. 20:55경 I, 2층에 있는 G 후보의 선거사무소에서 그곳에 있던 컴퓨터를 이용하여 문자전송 사이트인 (주)문자나라에 접속해 J 등에게 '안녕하십니까 F정당 K번 G 후보의 선대위원장 H입니다 (중략) F정당 G 후보를 선택해 주실 것을 간곡히 부탁드립니다.'라는 내용의 문자메시지 4,033건을 전송하고, 계속하여 ‘사랑하고 존경하는 C, D, E 시 군민여러분! F정당 K번 G 후보입니다 (중략) 반드시 투표해주시고 꼭! G 후보를 선택해 주시기 바랍니다 (중략) F정당 K번 G후보 드림’이라는 내용의 문자메시지 7,792건을 전송하였다.
