1. It is confirmed that each real estate listed in the separate sheet is owned by the plaintiff.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Facts of recognition;
A. The roads listed in paragraph (1) among each of the real estate listed in the separate sheet (hereinafter “each of the instant real estate”) are divided into B through B, and the roads listed in paragraph (2) are divided into D. According to the land survey records on the above B and D, all of the said two parcels were under the circumstances of E on May 14, 1914 (Seoul 3 years).
나. 일제 강점기에 작성된 구 토지대장 기재에 의하면, 분할 전 위 B, D에 관하여 1914. 5. 14. E(E, 주소: F, 기타 생년월일 등 인적사항은 기재되어 있지 않다)이 사정을 원인으로 소유자로 기재된 후 1923(大正 12년). 2. 8. 소유권보존 기재가 이루어졌고, 1929(昭和 4년). 6. 5. G(G, 주소: 괴산군 H)에게 소유권이 이전되었다.
그 후 1929. 6. 12. 위 B, D에서 이 사건 각 부동산이 분할되고, 이 사건 각 부동산에 관하여 1932(昭和 7년). 10. 24. 대창흥업주식회사(大昌興業株式會社, 경성부 남대문통 1정목 19)에 소유권이 이전되었다.

2. Determination
A. The judgment of the Defendant on the objection prior to the merits exists with respect to the instant real estate land cadastre, and since it was registered as the owner by Dae Chang Chang Chang Construction Co., Ltd. located in 19 from the land cadastre, it does not constitute the case where the registrant on the land cadastre does not exist or is unknown, and the Defendant contests its ownership.
