A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

"2017 Highest 1311" defendant is an employer who is engaged in personal building business.

When a worker dies or retires, the employer shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred.

Nevertheless, the Defendant did not pay KRW 1,253,00, the sum of KRW 3,750,000 for G wage of KRW 5,978,00 and KRW 5,978,00 for G wage of KRW 3,750,00 employed by the Defendant at the site of construction of a new hotel located in Seopo-si E in Seopo-si from January 18, 2016 to February 27, 2016, as well as KRW 7,148,00 for G wage of KRW 2,145,00 for a total of KRW 7,148,000 for a period from April 27, 2016 to July 15, 2016, under employment of the Defendant at the site of a new hotel located in Seopo-si in Seopo-si, and did not pay it within 14 days from the date of an agreement between the parties to the retirement.

The defendant of "2017 Highest 1768" is a person who operates K "K" in the business of another J of Seopo-si, Seopo-si.

If a foreigner intends to find an employment in the Republic of Korea, he/she shall obtain the status of sojourn eligible for employment activities, as prescribed by Presidential Decree, and shall not employ a person who has no status of sojourn eligible for employment activities.

Nevertheless, the Defendant, on November 11, 2016, entered Jeju-do as Jeju-do-free certificate and did not have the status of sojourn for job-seeking activities, at the intervals of KRW 100,000 per day, and employed from that time until February 8, 2017, the Defendant, at the construction site of the second multi-family house located N in Seopo-si, Seopopo-si.

Accordingly, the defendant employed a person who does not have the status of sojourn eligible for job-seeking activities.

The defendant of "2017 Highest 338" is a K representative in the jurisdiction of Seogpo-si, Seopo-si, who runs a construction business.

When a worker dies or retires, the employer shall fourteen days after the cause for such payment occurred.
