Reasons
Punishment of the crime
On July 23, 2015, the Defendant was sentenced to a suspended sentence of 8 months in the Jeju District Court for night buildings, intrusion upon buildings, larceny, etc., and on July 22, 2016, the Defendant was sentenced to five months in prison at the 9th Military Court on July 30, 2016, and the said sentence became final and conclusive on July 30, 2016, and the said suspended sentence was invalidated. The Defendant was released on March 31, 2017 in the military prison, and the parole period expired on April 27, 2017.
1. Night-time theft of buildings;
A. On June 9, 2019, around 05:11, 2019, the Defendant intruded into the victim C through the “D” window operated by the victim C at Jeju-si, which was not corrected at the main point, and stolen the cash of KRW 300,000 owned by the victim in the safe.
B. On June 11, 2019, around 00:45, the Defendant: (a) intruded into the victim F in the Jeju City E through the same Dong window that was not corrected at the time of the restaurant; and (b) stolen the cash amount of KRW 300,000 owned by the victim in the treasury.
C. On July 8, 2019, around 00:25, the Defendant intruded into the “J” restaurant operated by the victim I at H on July 8, 2019, and then stolen cash worth KRW 100,000 owned by the victim in the safe.
2. On July 3, 2019, around 08:47, the Defendant intruded into a building via a “D” window operated by the victim C, as stated in paragraph 1(a), and stolen cash owned by the victim and stolen KRW 5,000,000, located in the safe, without correction of the main points.
