A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On July 30, 2009, the Defendant: (a) subscribed to the Victim D Apartment 3 and 108, the Plaintiff: (b) from July 8, 2009 to August 8, 2009, the Defendant hospitalized the Plaintiff into the “Undividended D apartment 3 and 108; (c) and (d) from July 8, 2009 to from August 8, 2009, the Defendant was hospitalized into the “E” in the insurance contract subscription form to the effect that he was hospitalized five times or more during that time; (d) however, the Defendant submitted the question of the “The obligation to notify before the contract was diagnosed by a doctor within the last three months; (e) whether the medical examination, examination was conducted within the last five years; and (e) whether the result was hospitalized; (e) was hospitalized; (e) was hospitalized; or (e) was hospitalized for at least seven consecutive days after the medical examination or was administered for at least 30 days.” (c)
From October 7, 2009 to October 30, 2009, the Defendant was hospitalized for 24 days in G Hospital located in Busan Suwon-gu under the name of the disease, such as spatitis, spatitis, and luminous infection.
However, on December 16, 2009, the Defendant received KRW 720,000 as the insurance money on December 18, 200, when he received KRW 720,000 from the victim, even though the Defendant did not need to receive medical treatment for the above name of illness, or there was no need to receive hospital treatment with sufficient medical care only for the purpose of receiving insurance money under the above insurance contract.
In addition, from around that time to May 7, 2013, the Defendant repeated the release from prison to 21 hospitals at a total of 50 times (798 days of hospitalization) as shown in the attached list of crimes, and deceiving the victim by the same method, and was issued KRW 57,781,119, in total, 54 times from the victim.
