1. The plaintiff's claim is dismissed.

1. Details of the disposition;

A. The plaintiff was a social welfare foundation that obtained permission for incorporation from Busan Metropolitan City on October 12, 1997, and operated the Busan Metropolitan City General Welfare Center located in Busan Metropolitan City on October 22, 2001.

B. On January 17, 2014, Busan Metropolitan City notified the operation support plan of the Social Welfare Center in 2014, stating that “In relation to the improvement of the standards for operating expenses of the Social Welfare Center, the former has been differentiated according to the size of the facility and the size of the facility in accordance with the standards for adequate human resources according to the function of the Social Welfare Center and the performance of the project, considering the regional specificity, the personnel expenses and operating expenses shall be strictly divided and executed, and the personnel expenses shall not be used for any purpose other than the standards.”

C. On January 20, 2014, the Defendant: (a) applied to the Plaintiff, an indirect subsidy program operator, for a subsidy program; (b) on January 20, 2014, pursuant to the Plaintiff’s application details for a subsidy support plan for the operation of the Social Welfare Center, the Defendant applied for a subsidy program in Busan Metropolitan City; (c) “the content of the subsidy program: the function of providing services; etc.; (d) the period of the subsidy program: from January 1, 2014 to December 31, 2014; and (d) the subsidy: 514,240,000 won (including KRW 12,353,520,000), etc.; and (c) the Busan Metropolitan City applied to the Defendant for a subsidy program with the total of KRW 514,240,000,000, KRW 600,0000, KRW 400,000; and (c) the Defendant applied to the Defendant for a subsidy program.

1) Subsidies 1) Subsidies consisting of the operation of the Social Welfare Center and the operation of the Home Welfare Service Center, 2) Subsidies shall not be used for any other purpose and may be recovered at the time of conversion into other project costs.
