A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On April 22, 2015, the Defendant was sentenced to 8 months of imprisonment and 2 years of suspended execution for the violation of the Road Traffic Act at the Incheon District Court on April 2, 2015, and the said judgment became final and conclusive on April 30, 2015.

1. On December 4, 2015, the Defendant violated the Road Traffic Act (free license) driving of DK5 automobiles without obtaining a driver’s license on December 23:16, 2015, and proceeded with approximately 67 km sections from the front side of the Jin University located in Incheon Southern-gu to the roads near Chungcheongnamjin-gun, Chungcheongnam-do.

2. When the Defendant was driving a vehicle without obtaining a driver license at the time and place under paragraph (1) of this Article, the Defendant: (a) left the site by leaving the site without obtaining a driver license; and (b) stated, “In order to collect this, the Defendant was present at the police station in the Incheon Southern Police Station and made a statement that he would cause an accident while driving the vehicle; and (c) made F to make a false statement as if he caused an accident while driving the vehicle.”

Accordingly, around 14:10 on December 7, 2015, the F made a statement to the effect that he/she caused an accident and escaped while driving a 5 vehicle at the Incheon Southern Police Station Security Service and a traffic accident investigation department office located in 290-gil 32, Nam-gu, Incheon, Nam-gu, Incheon, and that he/she attempted to flee.

As a result, the defendant instigated F to escape a person who commits a crime corresponding to a fine or heavier punishment.
