Defendant
A and Defendant C shall be punished by a fine of KRW 5,00,000, and Defendant B shall be punished by a fine of KRW 500,000.
Reasons
Punishment of the crime
1. Defendant A, as the representative director of Korea-U.S. G, 4, and 2 pharmaceutical products manufacturing chain C (hereinafter “C”), is manufacturing and selling the e-mail drugs preparation “H”, a non-pharmaceuticalal product, as a non-pharmaceuticalal product.
(a) A person who intends to engage in the business of importing non-pharmaceuticals shall report to the Minister of Food and Drug Safety on his/her import business, as prescribed by Ordinance of the Prime Minister, and obtain permission from or report to the Minister for Food and Drug Safety for each item, as prescribed by Ordinance of the Prime Minister;
Nevertheless, the defendant did not report the import business of non-pharmaceutical drugs at the location of the above C, and imported from the Chinese company ’s â……………………………………â………………â……………â………………………âââââ……………ââââââââââââââââââââââââââââââââââââââââââââââââââââââââââââââââ
(b) No one shall sell, store or display for sale, non-pharmaceutical drugs imported without permission;
Nevertheless, around December 18, 2015, the Defendant sold at the above-mentioned paragraph (a), 55,000 won, 10 cart storages, which are non-licensed drugs, at the location of the Defendant, as indicated in the foregoing paragraph (a), and sold 39,036 cart storages, totaling 180,790,000 won, from March 11, 2016 to March 11, 2016.

A manufacturer of non-pharmaceuticals or a person who has obtained marketing approval of non-pharmaceuticals shall accurately manufacture non-pharmaceuticals in accordance with the product standards, etc. concerning the manufacture or quality control of non-pharmaceuticals.
The Defendant is a mixture of 0.04g of ethyl 0.04g of the beginning oil of the year, which is a principal ingredient, in accordance with the product standard form for H, which is a product made by an electronic gold metal preparation (hereinafter “H”), and the Defendant is a mixture of 0.2g of ethyl 0.04g of the base oil of the year, which is a principal ingredient, 0.01g of betalycera, 0.23g of the glycerine, and 0.52g of propyol, and then packages them with the cryr, etc.
