Defendant shall be punished by a fine of KRW 7,000,000.
If the defendant does not pay the above fine, 50,000 won.
Reasons
Punishment of the crime
1. Around 04:30 on February 6, 2013, the Defendant driven a B Schlage vehicle under the influence of alcohol concentration of about 1.5 meters without a driver’s license, from around the road near the Goyang-gu Goyang-gu, Goyang-gu, Goyang-si to the front road near the Goyang-dong 337 km-dong 337 km-dong.
2. After committing the crime of paragraph (1) above, the Defendant: (a) stated “E” in the driver’s name column under the part below the phrase “E” stating that the above description is inconsistent with the facts; (b) confirmed that the above description is identical to the fact; (c) notified that the Defendant may collect blood if he recognizes it as a result of the measurement, but did not want to do so; and (d) marked “E” in the driver’s name column under the part below the phrase “E” on the driver’s name stating that “I will confirm that the above description is inconsistent with the facts and affix their signature and seal”; and (d) stated “I” in the driver’s name column under the part below the phrase “I signed that I will not want to do so.”
Accordingly, for the purpose of exercising a certificate of fact, the Defendant forged the driver column in the report on the master driver's actions, and the report on the status of the driver's actions, which is a private document about the certificate of fact.
3. The Defendant: (a) submitted to F, at the time and at a place specified in Paragraph (2) and at the same time and at a place, each driver column of the forged “HHA Report”; and (b) the “Report on the Statement on the State of PHA Report,” which had been recorded as stated in the said paragraph, to each of the aforementioned policemen.
