A defendant shall be punished by imprisonment for not less than three years and six months.

Seized evidence shall be confiscated as referred to in subparagraphs 3 through 8, and 11.

Punishment of the crime

On February 2, 2001, the Defendant was sentenced to imprisonment with prison labor for a violation of the Management of the Local Mental Drugs Act at the Busan District Court on February 2, 2001, and was sentenced to five times more.

The defendant of "2016 Highest 5077" is not a person handling narcotics.

1. Provision of Metropists;

A. On January 1, 2015, the Defendant provided approximately 0.06g of the Meart clocks (one philopon; hereinafter referred to as the “Melopon”), a local mental medicine, to E, in the vicinity of Busan Southern-gu, Busan-gu.

B. On January 2016, the Defendant provided approximately 0.06g 0.06g philopon to E from a passenger car driven by E located near Busan Southern-gu, Busan-gu.

2. On July 2015, the Defendant: (a) around G located in the Busan Dong-gu, Busan; and (b) around 50 grams from H on the pretext of the repayment of loans to H KRW 4 million; and (c) on the basis of the repayment of loans to H, around 50 grams.

3. Sale of cryptop bags;

A. On January 10, 2016, the Defendant: (a) in the vicinity of Busan metropolitan area D; (b) received KRW 250,000 from E; and (c) sold approximately 0.7 gal-phones to E.e.

B. On January 14, 2016, the Defendant: (a) received KRW 250,00 from E in the vicinity of the Southern-gu Busan, Busan; and (b) sold approximately 0.7 grams of philophone to E.

On May 2016, the Defendant got 200,000 won from J Hospital located in Busan-gu I, and sold approximately 0.35 g of philopon to E.

4. On November 8, 2016, around 23:05, the Defendant, holding Mepters, posted approximately 0.39g philopon on the part of the Defendant, and posted approximately 12.6g philopon on the part of the Defendant’s main machine.

5. On November 8, 2016, the Defendant owned approximately 11.36 grams in total, on bail in shopping bags, at the Defendant’s house located in the Nam-gu Office of Busan (K. 506) on November 23:40, 2016, and owned approximately 11.36 grams in total, by inserting them into four plastic bags.
