Defendants shall be punished by imprisonment for one year.

However, the defendants are above three years from the date of this judgment.

Punishment of the crime

The Defendants, who is not a narcotics handler, did not sell, receive, administer, or administer camphophones (one philopon; hereinafter “philopon”), which is a local mental medicine, but dealt with philopon as follows.

1. Purchasing philophones;

A. On July 2016, the Defendants conspired with E to jointly purchase and administer phiphones, and around 17:00, Defendant A purchased phiphones by finding out the number of phiphones contained in vinyls from the runway near Gangnam-gu, Seoul to the designated account of the online “F” seller, and Defendant B transferred the above KRW 300,000 to the designated account of the online “F” seller at around 19:00 on the same day.

B. On August 2016, the Defendants conspired with E to jointly purchase and administer phiphones, and around 17:00, Defendant A purchased phiphones in a manner that the Defendants transferred KRW 500,000 to Defendant B’s designated account of the seller of phiphones, and Defendant B transferred the above KRW 500,000 to Defendant B’s designated account of the seller of phiphones. On the same day, around 20:00 on the same day, the Defendants purchased phiphones in a way that the Defendants would find the phiphones in a structural way near the subway H station of the subway located in Gangnam-gu Seoul Metropolitan City.

On August 2016, the Defendants conspired to jointly purchase and administer philophones with E, and around 18:00, Defendant A purchased philophones in a way that Defendant B 50,000 won in the purchase price of philophones to the designated account of the seller of philophones. Defendant B wired the above 500,000 won to the designated account of the seller of philophones, and around 20:00 on the same day, Defendant B purchased philophones by finding the amount of philophones contained in vinyls around the Seoul Gangnam-gu I Station.

The Defendants jointly carry out philophones with J (the same day conditional suspension of indictment).
