A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

On October 6, 2016, the Defendant was sentenced to two years of imprisonment with prison labor for the commission of property acquisition at the Incheon District Court for six months, and was sentenced to four months of imprisonment with prison labor for the obstruction of performance of official duties at the Seoul East District Court on June 28, 2017, which became final and conclusive on November 24, 2017, and the sentence of the said suspension of execution was invalidated and the execution of the final sentence was terminated on June 3, 2018.

Since it is deemed that there is no obstacle to the defense of the defendant, it shall be corrected and stated ex officio.

1. 피고인과 B, C의 공동범행 피고인과 B, C는 집을 가출하여 어울려 다니면서 생활비 등을 마련하기 위하여 인적이 드물고 관리가 소홀한 인형뽑기 가게에 들어가 지폐교환기 내에 있는 현금을 절취하기로 마음먹고, 피고인은 범행장소를 물색하고 렌트한 차량을 운전하여 범행 장소로 간 뒤 대기하는 역할을 하고, B은 범행에 이용할 절단기와 드라이버를 준비하고 가게에 침입하여 현금을 절취해 오는 역할을 하고, C는 휴대폰 핫스팟을 켜서 범행 장소로 이동 중에 차량 네비게이션을 이용할 수 있도록 데이터를 제공하고 B이 현금을 절취해 나오는 동안 A과 함께 대기하는 역할을 하기로 공모하였다.
