1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. On August 22, 2007, the Plaintiff entered into an insurance contract on the separate sheet list with the insured as the Defendant (hereinafter “instant insurance contract”). Of the instant insurance contract, the securities number C shall pay KRW 30,000 per day with a general injury provisional living expenses special agreement, and KRW 30,000 per day with a disease hospitalization expenses, and the securities number D shall pay KRW 20,000 per day with a general injury provisional living expenses special agreement, and KRW 20,000 per day with a special contract for a general injury provisional living expenses, and shall pay KRW 5,00,000 per day with a special contract for a 16th specific disease security.
B. On February 12, 201, 201 after the conclusion of the instant insurance contract, the Defendant began to receive hospitalized treatment for 21 days at E Hospital from February 201 to December 2013 as a shower 21 days, and received insurance proceeds of KRW 23,350,000 in total from the Plaintiff due to ordinary injury, temporary living expenses, disease hospitalization expenses, etc., as indicated in Table 1, as follows, from February 2011 to December 2013.
C. Meanwhile, the Defendant and the appointed parties B are as follows: (a) the details of the insurance contract to which the Defendant married couple joined due to the marital relationship are indicated in Table 2; and (b) the insurance amount that the Defendant married couple received from the insurance company including the Plaintiff according to each insurance contract is the aggregate of KRW 114,606,060
