A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On July 29, 2018, the Defendant was aware that the transfer of the means of access to a bank bank deposit account opened under the name of the Defendant to C was used for the crime of Bophishing, due to the transfer of the means of access to the bank deposit account in the name of the Defendant around February 28, 2018. On October 14, 2018, the Defendant came to know that the transfer of the account and card was to be used for the crime of Bophishing, because he/she was suspected of violating the Electronic Financial Transactions Act at the Seoul Gangseo Police Station. On the one hand, he/she, who was aware of through the “D” website from his/her name-free person who was aware of the fact that he/she was to deliver the card by collecting the 70,000 won per case. “On the other hand, he/she must drive 10-12 hours per day.” Upon receipt of the proposal, he/she received the consent to do so, and then, collected the content and then sent the card to his/her name.

Nevertheless, around October 17, 2018, the Defendant collected and delivered stuff cards in the name-free boxes’ name in Gwanak-gu, Seoul Special Metropolitan City, by mail, and received the price from G Bank deposit account (H) in the name of the Defendant. From that time until October 24, 2018, the Defendant, as indicated in the separate crime list, delivered the neck card at 16 times prior to that time, and received and delivered the means of access with the knowledge that it would be used for the crime by receiving a total of KRW 1,540,000,000 as indicated in the list of crimes.

2. On October 24, 2018, the Defendant of the means of access, as indicated in paragraph (1), collected a e-mail card connected to the K Bank Deposit Account (L) in the Cheongju-si Office I from the K Bank Deposit Account (L) and deliver the e-mail card connected to the J M Bank Deposit Account (N) to the Seongbuk-gu Seoul High-gu Seoul High-level Office’s e-mail, designated by the winners of the e-mail.
