A defendant shall be punished by imprisonment for one year.

Punishment of the crime

Around March 14, 2014, the Defendant: (a) linked to the “Dpia” on the Internet’s trading site “Nbagyna; (b) made and posted a false statement to the victim E, who reported and contacted, stating that “I will jointly order and deliver Nakia Sympies and Pool sand”; and (c) received KRW 335,000 from the victim to the new bank account (F) in the name of the Defendant under the name of the victim as the price for goods.”

However, in fact, the defendant posted a letter of sale along with a new photograph taken by him while working as a new employee, and the amount of money received as a new letter of sale was used only for the Internet sports soil or for the cost of living, and there was no intention or ability to sell the above goods from the beginning.

In addition, the Defendant received a total of KRW 3,524,00 from 45 victims in the same way as indicated in attached Table 1, from around that time to June 2, 2014.

Accordingly, the defendant was provided property by deceiving the victims respectively.

On November 19, 2014, G 103 at the defendant's house located in G 103, the defendant prepared and posted a sales letter "I sell the portion of daily milk business," "I sell the portion of daily milk business," and reported this to the victim H who visited him/her as if he/she sold the above goods."

However, even if the defendant receives the price of the article from the victim, he did not have the intention or ability to sell the article.

As such, the Defendant, by deceiving the victim as such, received 27,00 won from the SC Japan bank account under the name of the Defendant for the same day as the price for the goods from the victim, and was in the same way as on January 19, 2014, as stated in the List 2.
