피고인들은 공모하여 2016. 7. 4. 경부터 2016. 8. 9. 경까지 ‘F ’에서, 청소년 이용 불가 게임인 서유기 전, 화룡성 등 게임기 70대를 구비하고, 게임 자동 진행장치인 일명 똑딱이를 설치하여, 그 곳을 찾은 손님들에게 1원 당 1점을 부여하고 1 회당 100점이 차감되는 방식으로 똑딱이를 이용하여 자동으로 게임을 하게 한 후 손님들 로부터 게임 점수에 적립된 금액의 반환을 요구 받으면 그 금액이 20,000점 이상인 경우에만 1 장에 10,000점의 가치가 있는 무기명 점수 보관 증( 무료 이용권) 을 발행해 줌으로써 교환가치를 부여하고, 손님들이 게임 장 안팎에서 위 카드를 다른 손님들에게 판매함으로써 이를 현금화 할 수 있도록 하였다.
