The punishment of the accused shall be determined by two years of imprisonment.
However, the above sentence shall be executed for three years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. 상해 피고인은 2014. 12. 9.경 정읍시 C아파트 동 주차장 앞에서 피해자 D(여, 26세)가 술에 취하여 땅바닥에 주저앉으려고 하는 피고인을 깨우기 위하여 피고인의 얼굴을 톡톡 때렸다는 이유로 화가 나서 손바닥으로 피해자의 얼굴 부위를 수차례 때리고 피해자의 머리채를 잡고 끌고 다녀 피해자에게 치료기간을 알 수 없는 얼굴의 표재성 손상 등을 가하였다.
2.
